Terms and Conditions for the GROHE SPA “Concierge Service”

(hereinafter: the “Terms”)

§1 Involved Parties

  1. A customer (“you”) can use the concierge service to be directed from Grohe group’s website (www.grohe.com) to a bathroom designer (“Designer/GROHE SPA Concierge”) for a free-of-charge design session on the utilization of GROHE SPA products (“Design Service”).
  2. The contact to the Designer is facilitated by an online application (Callme360 BOOKER; hereinafter: the “Tool”) available at http://grohespa-booking.com/. The Tool is managed by Sigmacem Analytics Sp. z.o.o., a Polish company with its registered office in Szczecin, ul. Rostocka 113/1, 71-771 Szczecin, Poland, entered in the Register of Entrepreneurs kept by the District Court in Szczecin under KRS number 0000443956, NIP 8971787082 (hereinafter: the “Operator”).
  3. The Tool is made available to users of the website www.grohe.com (hereinafter: the “User”) pursuant to an agreement between the Operator and Grohe AG, Feldmühleplatz 15, 40545 Düsseldorf, Germany (hereinafter: “GROHE”).
  4. The Operator provides the Tool and, on behalf of GROHE, performs the technical and organizational handling of the booking process and coordinates the performance of the Design Service. The Operator does not provide to you the Design Service itself.

§2 Booking process

  1. Bookings are free of charge.
  2. Bookings are made online. The availability of Designers cannot always be guaranteed. Designers and dates are available directly in the Tool during the booking process.
  3. After a successful booking, a confirmation is sent to your email address and/or phone number.

§3 Design Service

  1. You may book the following Design Service:
    1. online bathroom design consultations with a Designer.
    2. Utilization of products (GROHE SPA brand).
  2. Course of the Design Service
    1. The Design Service is of a consultation and design nature and is performed in stages. It may include in particular:
      1. an initial online consultation with a Designer (approx. 15 minutes) to identify your needs and expectations,
      2. providing you with instructions on how to prepare for further design work (e.g., taking measurements or preparing documentation),
      3. a main online design session (approx. 2 hours),
      4. preparation of design materials, layout concepts or design documentation (the “design file”).
  3. The detailed scope, form and duration of the Design Service may vary. Should you require extended services, please be aware that the Designer should inform you if there is any cost which is not part of the Design Service.

§4 Technical Requirements

  1. GROHE’s website is adapted for both desktop and mobile devices. The Operator, unfortunately cannot always guarantee full functionality on every device or software configuration.
  2. No additional applications or plugins are required.

§5 Personal Data Processing

  1. The Controller of personal data collected during the booking and related to the Design Service is GROHE. The Operator acts as a data processor and processes personal data solely on behalf of and under the instructions of GROHE to handle the booking process.
  2. The Operator processes in particular: name, surname, email address, phone number, and appointment details. Technical data (e.g., IP address, system logs) may also be processed.
  3. The data will be processed in order to carry out the booking. Providing data is voluntary but necessary to conclude and perform the Design Service.
  4. Personal data is not sold or shared for marketing purposes and will be deleted once the purpose has been fulfilled Some data may be entrusted to third parties solely for contract performance purposes.
  5. GROHE has appointed a Data Protection Officer (dataprotection@grohe.com).

§6 Booking details

  1. Bookings can be made 24/7, except during technical maintenance.
  2. You select the Designer and date.
  3. After booking, you must confirm the booking by clicking the link in the email within the time specified in the message (typically 15 minutes).
  4. If the booking is not confirmed, this will result in automatic cancellation.

§7 Final Provisions

  1. Governing law and jurisdiction

    The provision of the Design Service is governed by German law and the venue for any disputes shall be at GROHE’s office in Düsseldorf, Germany.

  2. Liability

    GROHE and/or the Operator are not liable for any conceivable harmful consequences of your consultation with the Designer or the decision to use the Design Service as such Such exclusion of liability does not apply in cases of any conceivable wilful misconduct or injury to life or limb.

  3. These Terms may be amended due to:
    1. changes in law,
    2. technical changes,
    3. changes in contracting processes,
    4. service improvements or security enhancements,
    5. changes in Operator or Ordering Party details,
    6. correction of errors or ambiguities.
  4. You will be informed of amendments by publication of the updated Terms within the Tool.
